Trademarks

Factual’s innovation is embodied in its Intellectual Property, including Patents, Trademarks, and Copyrights.

Factual Trademark List

At Factual, we believe that our legal name, our trade names, our brand, our trademarks and our services marks represent and convey our good name and the goodwill of our company. This section shows and explains the usage of these names and elements.

A trademark can be a word, phrase, symbol, or design that distinguishes the source of the goods or services. Also, as trade dress, it can be the appearance of a product or its packaging, including size, shape, color, texture, graphics, and appearance (e.g, website).

The following is a non-exhaustive list of Factual’s trademarks and service marks.

When using the marks in publications that will be distributed only in the United States, include the appropriate ™, ℠, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: Geopulse is a trademark of Factual Inc., registered in the U.S. and other countries.

The list also includes a suggested generic term for each trademark. For all publications, include an appropriate generic term after the trademark the first time it appears. Thereafter, the generic term should appear frequently with the trademark. (These generic terms are only suggestions, and there may be other words that are equally appropriate.)

Trademarks are adjectives, and should not be made into verbs or made plural or possessive.

For more information on how to use Factual’s trademarks, please contact us at legal@factual.com.

The absence of a product or service name or logo from this list does not constitute a waiver of Factual’s trademark or other intellectual property rights concerning that name or logo.

  • When using a Factual trademark, distinguish the trademark from the surrounding text in some way.
  • All Factual logos on web pages must be clickable and link back to http://www.factual.com
  • Always spell and capitalize the trademark exactly as they are shown in the Factual Trademarks and Suggested Accepted Generic Terms above.
  • Do not change the mark in any way. Do not remove, obstruct, distort, or alter any element of a Factual trademark. This includes modifying the Factual word mark, for example, through hyphenation, combination abbreviation, or acronyms.
  • Make sure the Factual logo is full and clearly visible, and never altered or partially covered.
  • Do not use the Factual logo in ways that (1) imply an association with or endorsement of any other product, service, event, sponsorship, or organization; (2) can be reasonably interpreted to suggest editorial content was authored by Factual; or (3) represent the views or opinions of Factual or Factual personnel without prior written permission from Factual. All of the aforementioned usages must be approved via written permission.
  • Do not adopt marks, logos, slogans, or designs that are confusingly similar to the Factual trademarks or imitate Factual trade dress, including the look and feel of Factual web design properties, Factual brand packaging, distinctive color combinations, typography, graphic designs, product icons, or imagery associated with Factual.
  • Do not register the Factual trademarks as second-level domain names or incorporate Factual trademarks into your own product name, service names, trademarks, logos, or company names.
  • Never display a Factual trademark in a manner that is misleading, unfair, defamatory, infringing, libelous, disparaging, obscene or otherwise objectionable to Factual.
  • Never display a Factual trademark on any website or user interface that contains or displays adult content, promotes gambling, promotes violence, contains hate speech, involves the sale of tobacco or alcohol to persons under twenty-one years of age, violates other applicable laws or regulations or is otherwise objectionable.
  • Trademark rights vary from country to country. Some countries have severe criminal and civil penalties for improper use of the registration symbol. Therefore, don’t use the registration symbol (®) in countries where the mark has not been registered.
  • If there is any question about usage, request for clarification or permission, please contact Factual (http://www.factual.com/contact).
